Store Regulations

§ 1. General Provisions

  1. These Terms and Conditions define the rules for using the online store available at www.kissenland.com (hereinafter referred to as the “Store”), operated by HMK Honorata Klimecka, with its registered office in Kliny, ul. Cicha 5A, 62-004 Kliny, NIP: 7821595363, REGON: 300720067 (hereinafter referred to as the “Seller”).

  2. The Store is an online platform that allows customers (hereinafter: the “Customer”) to purchase products offered by the Seller.

  3. Use of the Store is possible after the Customer has read and accepted these Terms and Conditions by selecting the appropriate checkbox during registration or when placing an order.

  4. The Seller reserves the right to amend these Terms and Conditions.

  5. Customers will be notified of any changes in a way that enables them to read the new terms at least 14 days before such changes come into effect.

  6. In matters not regulated herein, the provisions of the Civil Code, the Consumer Rights Act, and other applicable Polish laws shall apply.


§ 2. Definitions

  • Store – the online platform available at www.kissenland.com, allowing Customers to purchase products offered by the Seller.

  • Seller – HMK Honorata Klimecka, with its registered office at ul. Cicha 5A, 62-004 Kliny, NIP: 7821595363, REGON: 300720067.

  • Customer – a natural person, legal entity, or organizational unit without legal personality who makes or intends to make a purchase in the Store.

  • Product – a good offered for sale in the Store.

  • Order – the Customer’s declaration of intent submitted electronically via the Store, aimed at concluding a sales agreement for a Product with the Seller.

  • Account – the Customer’s individual account in the Store, enabling access to the Store’s functions, including order history, personal data, and settings.


§ 3. Terms of Use

  1. The Customer shall use the Store in accordance with applicable law, good manners, and these Terms and Conditions.

  2. The Customer is responsible for all actions performed through their Store account.

  3. The Customer is obliged to provide true and up-to-date personal data during registration or order placement.

  4. The Customer must keep login data confidential and is fully responsible for any actions performed using their account credentials.

  5. The Seller reserves the right to block access to a Customer’s Account in the event of a breach of these Terms and Conditions.

  6. The Customer may delete their Account at any time.

  7. Product prices are quoted in Polish zloty (PLN) or euros (€) and include VAT unless otherwise stated in the Product description.

  8. The Seller reserves the right to:

    • change Product prices,

    • introduce new Products,

    • remove Products from the offer,

    • conduct promotions and sales.


§ 4. Orders and Order Fulfilment

  1. The Customer places an Order by adding selected Products to the shopping cart and completing the checkout process, which includes providing personal and shipping details, selecting a payment method, and accepting these Terms and Conditions.

  2. After an Order is placed, the Customer receives an e-mail confirmation of order acceptance.

  3. Orders are processed within 3 business days from the date of placement, unless otherwise specified in the Product description.

  4. The order processing time starts upon successful payment authorization.

  5. Delivery costs depend on the courier service and the size/weight of the Product.

  6. The Seller may refuse to fulfill an Order if:

    • the Product is unavailable,

    • the Customer provides false or incomplete data,

    • the Customer violates these Terms and Conditions.

  7. The Customer may cancel an Order at any time before dispatch.

  8. The Customer has the right to return a Product within 14 days of receipt without providing a reason. Return shipping costs are borne by the Customer.


§ 5. Payments

  1. Online payments are processed by Autopay S.A.

  2. Available payment methods include:

    • bank transfer,

    • online payment by credit/debit card (Mastercard, Visa),

    • cash on delivery.

  3. Card details are provided directly to the payment operator and are not accessible to the Seller.

  4. For bank transfers, the Customer must make payment to the Seller’s bank account number provided in the Store.


§ 6. Complaints, Returns, and Warranty

  1. The Customer has the right to withdraw from the sales agreement within 14 days of receiving the Product.

  2. Complaints should be submitted via e-mail to shop@kissenland.com, including a description of the reason for the complaint.

  3. The Seller shall respond to complaints within 14 business days.

  4. The right of withdrawal does not apply to Products:

    • made to the Customer’s specifications,

    • personalized or custom-made (e.g. embroidery, labeling).

  5. Complaints cannot be made in the following cases:

    • color variations between printed materials and digital images,

    • minor dimensional differences within the same size or model,

    • conformity of the Product with the agreement.

  6. If a complaint is accepted, the Seller shall:

    • replace the Product,

    • repair the Product,

    • or, if not possible, refund the purchase price or offer a discount (individually agreed).

  7. Customers may use alternative dispute resolution methods, including:

    • the Permanent Consumer Arbitration Court at the Trade Inspection,

    • mediation proceedings before a provincial inspector of the Trade Inspection.


§ 7. Personal Data Protection and Privacy Policy

  1. The Seller processes Customers’ personal data in compliance with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679).

  2. The purpose of data processing is the fulfillment of orders.

  3. The legal basis for data processing includes:

    • Article 6(1)(b) GDPR – performance of a sales agreement,

    • Article 6(1)(c) GDPR – legal obligations regarding accounting,

    • Article 6(1)(f) GDPR – legitimate interest of the Seller (establishment or defense of legal claims).

  4. Details regarding data processing are provided in the Privacy Policy available on www.kissenland.com.


§ 8. Final Provisions

  1. These Terms and Conditions enter into force on 1 February 2025.

  2. The Seller reserves the right to amend the Terms and Conditions, with at least 14 days’ prior notice before the changes take effect.

  3. Any disputes arising from the implementation of these Terms and Conditions shall be resolved by the court having jurisdiction over the Seller’s registered office.
